2. Purpose

These terms and conditions regulate access to and use of the website, as well as the contracting of services offered by Surf Garage Sports Club.

The services offered include, among others:

  • Board storage (surfboards / wetsuits / bodyboards / surfskates)

  • Surf equipment rental

  • Use of changing rooms and showers

  • Sports activities organized by the club

  • Surfskate lessons

  • Skate lessons

  • Children's summer sports camps

  • Collaborations with other clubs or sports entities

  • Collaboration agreement with Bera Bera Surf Eskola to provide surf lessons within the summer camp sports program organized by Surf Garage Sports Club

  • Collaboration agreements with martial arts schools to provide activities within the summer camps or Easter programs organized by Surf Garage Sports Club

  • Other collaboration agreements that may benefit club members

3. Access conditions

Access to the website is free of charge.

Users agree to:

  • Use the website lawfully

  • Not engage in activities that may damage the website

  • Not use the content for fraudulent or illegal purposes

Surf Garage may restrict access to users who breach these conditions.

4. Contracting of services

Services may be contracted:

  • Through the website

  • In person at the premises

  • Through management platforms used by the club

Contracting any service implies acceptance of these terms.
Services are subject to availability and the club’s internal rules.

5. Prices

Service prices will be indicated on the website or at the club premises.
Prices may be modified at any time, although those in force at the time of contracting will be respected.

6. Rules for use of the facilities

Users must respect basic rules of coexistence and safety.

In particular:

  • Use equipment and facilities properly

  • Maintain order in changing rooms and common areas

  • Respect other users and club staff

  • Follow the instructions of responsible staff

The club may deny access to users who fail to comply with these rules.

7. Sports activities and liability

The practice of surfing, surfskating, and other sports involves inherent risks.

The user declares:

  • They are in suitable physical condition to carry out the activity

  • They assume the risks inherent to sports practice

In the case of minors, parents or legal guardians are responsible for registration and authorization.

8. Camps and children's activities

For camps or activities involving minors:

  • Parents or guardians must complete the corresponding registration form

  • They must inform of any allergies, medical conditions, or special needs of the minor

  • Schedules and rules will be those established by the club

Activities may be adapted or modified depending on weather conditions, sea conditions, or safety reasons.

During camps and children's programs, participants may walk between nearby locations (beach, sports facilities, or partner spaces), always under the supervision of instructors.

9. Collaborations with other clubs and sports entities

Surf Garage Sports Club may collaborate with other clubs, associations, sports facilities, or specialized professionals to carry out certain sports activities, training sessions, or workshops within its programs.

Some activities may take place in external facilities belonging to collaborating entities.

In such cases:

  • The entity owning the facilities is responsible for their safety, maintenance, and suitability

  • The instructors or coaches of the collaborating entity are responsible for the technical direction of the activity they provide

  • Surf Garage Sports Club acts as the coordinating or organizing entity for user participation

Participation in these activities may involve walking from the meeting point or club facilities to the partner entity’s facilities, always under instructor supervision.

Collaborating entities or professionals must have the required qualifications, insurance, and authorizations in accordance with current regulations.

10. Cancellations and withdrawals

Cancellation conditions may vary depending on the contracted service.

Board storage service cancellation:
Cancellation must be communicated before the 25th day of the last month of the contracted annual period.

Example:
If the board storage subscription starts on January 1, 2026, cancellation must be communicated before December 25, 2026.

The user must collect their equipment before the subscription end date.
The user will always receive an email with the start and end dates and must read it and comply with their obligations.

If cancellation is not communicated within the established period, the service will be automatically renewed for an additional year.

Cancellation of recurring activities (surfskate):
For recurring activities such as surfskate lessons, cancellation must be communicated at least one month before the next billing period.

If not, the club will consider that the user remains enrolled for the following period.

11. Stored equipment (board storage)

The board storage service consists of storing surfboards and sports equipment at the club facilities.

The user is responsible for ensuring that stored equipment is in proper condition and correctly identified.

Surf Garage Sports Club will take reasonable security measures to safeguard stored equipment. However, the club is not responsible for:

  • Damage resulting from normal use

  • Natural wear and tear

  • Damage caused by third parties or circumstances beyond the club’s control

Users are advised to have their own insurance for sports equipment, especially for high-value boards.

12. Rental equipment

Users renting sports equipment agree to use it responsibly and return it in the same condition as received, except for normal wear and tear.

Users are responsible for:

  • Damage caused by negligent use

  • Loss of equipment

  • Breakage due to improper use

In case of damage or loss, the club may request repair or replacement.

13. Use of images

During activities organized by Surf Garage Sports Club, photographs or audiovisual recordings may be taken for informational, promotional, or dissemination purposes.

In the case of minors, such images may only be used with the explicit authorization of parents or legal guardians, in accordance with current regulations.

Images may be used in:

  • The club’s website

  • The club’s social media

  • Informational or promotional materials

14. Intellectual property

All website content (texts, images, logos, graphic design, and visual elements) is the property of Surf Garage Sports Club or used under appropriate licenses.

Reproduction without authorization is prohibited.

15. Data protection

Personal data will be processed in accordance with the General Data Protection Regulation (GDPR) and applicable Spanish legislation.

16. Applicable law

These terms are governed by Spanish law.

For any dispute arising from the use of the website or the contracting of services, the parties submit to the courts of Donostia-San Sebastián.
